Legal dispute

The suspension of sales of Apple Watch 9 and Apple Watch Ultra 2 was officially announced by the Californian brand a 9 to 5 Mac and follows a legal dispute that has been ongoing since 2020. At the center of the dispute are medical technology patents received on Apple smartwatches for detecting parameters such as blood oxygenation (pulse oximetry) through a series of LEDs that allow these values ​​to be monitored day and night. Masimo is one of the leading companies in the meditech sector and has accused Cupertino of misusing its technology solutions.

The last OctoberITC (International Trade Commission – International Trade Association) recognized Masimo’s reasons and forced Apple to withdraw from the sale of devices that adopted these technologies. Apple denied the allegations and emphasized that after the decision was announced a period of 60 days is assumed during which the US government – in the person of President Biden – can still challenge the verdict by blocking the procedure.

The deadline for this option is set for December 25th, but given that such an event has rarely happened in the past, Apple has confirmed that it wants to move ahead of schedule: “We are taking precautionary measures to comply with the ruling, including suspending sales of the Apple Watch Series 9 and Apple Watch Ultra 2 on Apple.com starting December 21st and at Apple retail stores after December 24th. This decision currently has no impact on the sale of the device in other countries.”

No consequences for Italy
